FMLA Claims

The Family and Medical Leave Act (FLMA) entitles employees up to 12 weeks of unpaid job protection under any of the following circumstances:

  • The birth and care of a child
  • Placement of a child of either foster care or adoption
  • Caring for an immediate family member due to illness
  • Serious health condition

The Family and Medical Leave Act applies only to employers with at least 50 employees and the employee must:

  • Been employed for at least 12 months with employer
  • Worked at least 1,250 hours during the 12 months following the FMLA leave
